(Terms of use for Game Developers) – Conditions for publishing your games.

The purpose of this document is to detail the relationship between developers and OppaiMan. If, after reading this document, you still have any questions, you can e-mail us, and we'll get back to you as soon as possible. E-mail: help@oppaiman.com.

 

Publishing game or content

What we offer: OppaiMan offers a platform for you to make your Applications (games, content) available to other users and/or to OppaiMan itself, at its sole discretion.

Requirements: You must be 18 years or older to have a user account and upload content. By creating your account and uploading it to our platforms, you agree to OppaiMan’s Terms of Use and Privacy Policy and are subject to them.

Content on third-party sites: The content of this page and our Terms of Use/Privacy Policy are valid only for uploads and transactions carried out directly on OppaiMan’s website. Any content redirected from a third-party site must comply with the provisions set by the site/platform’s administrators.

Permissions and declarations: By uploading content to make it available to other users, you grant OppaiMan and its affiliates a worldwide, non-exclusive right to use, reproduce, use the content in part or in whole for purposes of disclosure, distribution, communication, public display, presentation, and public performance, of the Application/Content and derivative works thereof, for the purpose of operating, distributing, incorporating as part of, and promoting OppaiMan’s services, games, or other offerings, including subscriptions. This license is granted to OppaiMan once the content is uploaded to the platform for the duration of the intellectual property rights.

You agree that submitting your Application brings significant exposure, as well as the opportunity to share it for your enjoyment and to gain recognition that you may receive from other Subscribers.

Additionally, you declare and warrant that your Application, as well as its submission and your granting of rights to that content do not violate any contract, applicable law, or regulation.

Restrictions

Content Not Allowed

We do not allow you to publish an Application that violates our terms or policies. At any time, through moderation, we may remove any content that does not comply with what our platform proposes.

Keep in mind that most content on OppaiMan’s website is only permitted for users 18 years or older. We are not obligated to allow any particular person or group of people to access an offering or use the services on our website.

In summary, we do not allow content that:

• is illegal and/or infringes on the legal rights of others, including copyright;
• provides private or confidential information of third parties without their approval;
• is corrupted or contains files that could damage Users or the operation of OppaiMan;
• is otherwise harmful or misleading (content that is not formally illegal but may be considered unethical and socially undesirable for other reasons, such as misinformation, violence, racism, or xenophobia).

What should I do if my content is mistakenly flagged as infringing?

We rely on our moderators to ensure a safe environment on OppaiMan, despite the challenges of judging each situation individually. We acknowledge that everyone can make mistakes, so if you believe your content was mistakenly flagged as infringing, please contact our moderators for review via email at help@oppaiman.com. You will have 6 months to request this review, and we will be available to clarify the decision or correct any errors.

Intellectual Property

Who owns the copyright for the content I publish?

Third-party content available through OppaiMan’s portals is the property of its respective owners, as are any works protected by copyright, trademarks, or other intellectual property rights therein—all of which are the responsibility of the respective owners. You agree to indemnify OppaiMan for any claims related to copyright, trademarks, or other intellectual property claims.

You declare and warrant that you have the necessary rights to all content and applications submitted by you to offer them to OppaiMan, as well as to other parties affected by reproduction licenses or any specific license terms for the Application. This includes, but is not limited to: any kind of intellectual property rights or other proprietary or personal rights affected by or included in your content.

By publishing a game on our website, you grant OppaiMan a worldwide, non-exclusive license, subject to our distribution policies, sublicensable to use, reproduce, distribute, display, and promote the game as necessary for the operation and promotion of the marketplace content. OppaiMan will not claim ownership of the content you publish.

Unless expressly agreed otherwise, you must not copy, modify, publish, or transfer any content from OppaiMan. Except as permitted by law, you must not decompile, reverse engineer, or break any encryption that protects such content. You must not distribute or disclose any information or material from OppaiMan's platforms to third parties, including data related to yourself or the company’s sales and activities. What can I do if I find some of my content on OppaiMan’s website that I did not authorize?

We respect intellectual property and expect our users to do the same. If you believe that your copyrighted work has been copied and is available on a website or online service operated by us, you may notify us in accordance with the European Union’s Directive 2000/31/EC on Electronic Commerce, Regulation 2022/2065 on the Digital Services Act, or the U.S. Digital Millennium Copyright Act of 1998 (DMCA).

To file a copyright infringement notice, send an email to help@oppaiman.com. Include:

a) A detailed explanation of why you believe the content infringes your copyright, including the identification of the violated work;

b) The exact location of the content, such as URLs and, if necessary, additional information to clarify the part of the content in question;

c) Your name and email address;

d) A good faith statement confirming that the information provided is accurate and complete and that you are authorized to act on behalf of the copyright owner, under penalty of perjury in accordance with the DMCA;

e) A physical or electronic signature of a person authorized to represent the copyright owner.

Please note that the information in your notice may be shared with the person who provided the allegedly infringing content.

Furthermore, under Section 512(f) of the DMCA, intentional misrepresentation of information regarding infringement may result in liability for damages. Please be cautious when submitting your notice.

Non-Exclusivity

What do I need to know about publishing my content on OppaiMan?

Freedom of Publication: You acknowledge and agree that the license granted to OppaiMan to publish and distribute your game on our site is non-exclusive. This means you retain the right to publish, distribute, and promote the game on other marketplaces, platforms, and distribution channels without restrictions or obligations to OppaiMan.

Company Freedom: Similarly, OppaiMan reserves the right to negotiate, publish, and distribute games from other developers that may be similar or identical to your game without it constituting a violation of these Terms.

No Guarantee of Exclusivity: OppaiMan does not guarantee that your game will be the only one available on our site, nor that you will have any exclusive advantage over other developers. At our discretion, we may offer similar products or services from other developers.

Waiver of Exclusivity: By agreeing to these Terms, you waive any right to exclusivity on our marketplace and accept that OppaiMan may, at any time, allow the publication and distribution of competing games by other developers.

Privacy

What information do I need to provide to publish Content/Applications on OppaiMan’s website?

You provide some data directly when registering an account with OppaiMan or by providing your Patreon account. Other data is provided automatically through “cookies” or from third parties, such as Patreon and other OppaiMan partners.

By using the platform to publish your Applications, you consent to our data processing and guarantee that all data provided by you is accurate. Note that sharing additional information will be necessary if you want to make content available on our site, to ensure the proper functioning of the platform and the payment process.

What are my duties as a developer/creator?

Responsibility for data: As a creator, you are also responsible for keeping user data secure. You agree with our Privacy Policy regarding any data you may receive concerning users who purchase your Content/Application. Any harm caused by you related to users’ personal data is your responsibility.

Responsibility for the Account: You are responsible for all activities that occur under your account and for maintaining the security of your access credentials. Notify OppaiMan immediately about any unauthorized use of your account.

We work with two payment methods: via third-party platforms or various online payment providers.

Payment Methods

OppaiMan offers the following payment options to compensate developers for games sold on our platform:

One-Time Payment:

The developer will receive a one-time payment for the sale of the game, corresponding to the total sale price established for the product minus the fees listed above.

OppaiMan will transfer the payment to the developer after the buyer's payment is confirmed.

The payment will be made within a period of up to 30 business days after purchase confirmation. 

Subscription Payment:

For games sold through recurring subscriptions, the developer will receive payments proportional to the subscription value, according to the plan chosen by the user.

The amount corresponding to the developer's share will be transferred in each billing cycle (monthly, quarterly, annually, etc.), after deducting the agreed-upon fees.

OppaiMan will notify developers about the payment, and the transfer will be made within 30 business days after the user’s subscription payment is received.

Changes to Payment Methods

OppaiMan reserves the right to change the payment methods available to developers, provided that such changes are communicated at least 30 days in advance. Any changes in fees or payment terms will be communicated clearly and transparently.

Cancellations and Refunds

One-time payment:

Once the payment is confirmed and access to the game is provided to the buyer, the developer cannot request a refund of the fees charged by OppaiMan and the payment providers, except in cases of breach of the agreed terms.

Subscriptions:

If the buyer cancels the subscription, the developer will not have to make any refunds for the period of use of the game with the active subscription. Canceling the subscription will not affect payments for billing cycles that have already been completed.

Game Availability After Subscription Cancellation

In subscription payment models, if the player cancels the subscription, the game they downloaded will remain available in the user's library for future downloads. 

Taxes

Taxes due are the sole responsibility of the taxpayer, as defined by local tax laws. The format of taxation and/or withholding of taxes may vary depending on the payment method chosen, as described in the "Payments" section above.

Advertising and Marketing

Promotions: OppaiMan is authorized to use the content for promotional dissemination through its communication channels.

You agree and grant us full freedom to display advertisements related to products available in the store.

We may display ads about store products to promote their sale and dissemination, either through the platform itself or through communication channels. These ads may be displayed visually, textually, or through any other appropriate advertising medium.

Legal:

It is important to highlight that all advertising and promotional actions will be carried out in accordance with applicable laws and regulations, respecting the rights of developers and customers involved. We commit to the accuracy of information disclosed in advertisements. If you do not want your content to be included in any type of promotional activity, please contact OppaiMan.

Governing Law & Venue

If you encounter any issues, please contact us initially so we can try to resolve the situation as quickly as possible. Note that any dispute with us must be resolved under Florida law – United States of America.

If a dispute arises regarding your use of OppaiMan's platforms, the dispute will be resolved through arbitration or in the federal or state courts located in Florida. Florida law, excluding its conflict of law provisions, governs the relationship between you and OppaiMan. Note that any disputes related to third-party operations or platforms should be communicated directly to them.
